These Terms of Service ("Terms") govern your access to and use of the Packpeer digital packaging marketplace, sourcing agent and related services (the "Service") operated by Packpeer Limited ("Packpeer", "we", "us"). By creating an account or using the Service, you agree to these Terms.
Packpeer is a digital marketplace and AI sourcing agent that connects buyers with verified packaging manufacturers. We help you collect and compare quotes, place orders, generate packaging designs and print-ready artwork, run market simulations, and coordinate compliance, logistics and fulfillment.
Packpeer acts as an intermediary platform. Unless expressly stated, we are not the manufacturer of the products sourced through the Service.
Submitting a brief does not oblige Packpeer to design, quote or source; briefs are accepted at our discretion.
The Service uses automated systems, including an AI agent, to read briefs, source suppliers, draft designs and produce reports. The agent supports your decisions; it does not replace your judgement, and it does not enter binding commitments on your behalf without your approval.
Designs, artwork, quotes, compliance indications, supplier rankings and market simulations produced by the Service are generated automatically and are provided for your evaluation. They are estimates and recommendations, not guarantees of accuracy, availability, performance or outcome.
You are responsible for reviewing and approving any AI-generated output before relying on it or placing an order. Packpeer runs the loop; you give the final approval, and orders are placed only on your confirmation.
Market simulation results, including synthetic consumer panels, are predictive and illustrative. They do not guarantee real-world market performance, sales or consumer response.
You must provide accurate information when registering and keep it up to date. You are responsible for safeguarding your account credentials and for all activity under your account.
When you provide your email address in the brief flow, we create an account for you and send a secure sign-in ("magic") link; no password is set, and using the link signs you in.
You must be a business user with authority to enter agreements on behalf of your organisation. The Service is not intended for consumers.
Quotes generated through the Service are indicative until confirmed. An order is binding only once you approve it and, where required, payment or a payment commitment is received.
Prices may reflect live FX rates, applicable markups, duties and shipping terms (Incoterms) shown at the time of quotation. You are responsible for taxes and duties unless stated otherwise.
Payment terms, refunds and cancellations for each order are set out at checkout or in a separate order confirmation.
Buyers are responsible for the accuracy of briefs, specifications and artwork submitted, and for ensuring they hold the rights to any materials they upload.
Suppliers are responsible for meeting agreed specifications, quality standards, lead times and applicable regulations. Packpeer verifies suppliers but does not guarantee their performance.
You are responsible for ensuring that finished packaging meets all regulations applicable to your products and markets, including packaging and packaging-waste rules such as PPWR, food-contact safety, labelling and customs requirements. Any compliance checks offered by the Service are informational and do not constitute legal or regulatory advice.
To protect both sides of the marketplace, buyer and supplier identities may be masked until an order proceeds. You agree not to attempt to circumvent the platform to transact off-platform with parties introduced through the Service.
Each party must keep confidential any non-public information received through the Service and use it only to fulfil orders.
The Service, including its software, design and content, is owned by Packpeer and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable licence to use the Service.
You retain ownership of artwork and materials you upload, and grant Packpeer and relevant suppliers a licence to use them solely to produce and fulfil your orders.
Subject to payment and to any third-party rights, designs and artwork the Service generates from your brief are provided for use with your orders. You are responsible for reviewing AI-generated designs for originality and for any third-party rights, including trademarks and copyright, before production or public use. Packpeer does not warrant that generated output is free from third-party rights.
We process the briefs, artwork and other content you submit to operate the Service and fulfil your orders, as described in our Privacy Policy. We do not sell your data.
We may use aggregated or de-identified data to operate, secure and improve the Service, including its automated systems. We will not use your confidential briefs or proprietary artwork to train models in a way that discloses them to other users.
You agree not to misuse the Service, including by attempting to disrupt it, access it without authorisation, infringe others' rights, or use it for unlawful, fraudulent or harmful purposes.
The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, or that quotes, lead times or supplier information will be wholly accurate.
To the maximum extent permitted by law, Packpeer shall not be liable for indirect, incidental, special or consequential damages, or loss of profits, revenue or data.
Our total aggregate liability arising out of or relating to the Service shall not exceed the fees you paid to Packpeer in the twelve months preceding the event giving rise to the claim.
You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms or use the Service in a way that risks harm to Packpeer, its users or third parties.
Provisions that by their nature should survive termination — including IP, confidentiality and liability — will continue to apply.
These Terms are governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction over any dispute, without prejudice to mandatory consumer or local-law protections that may apply.
We may update these Terms from time to time. We will post the revised version with a new "Last updated" date and, where changes are material, take reasonable steps to notify you. Continued use of the Service constitutes acceptance of the updated Terms.
You will indemnify Packpeer against claims, losses and reasonable costs arising from your breach of these Terms, your briefs, specifications or uploaded materials infringing third-party rights, or your unlawful use of the Service.
Neither party is liable for delay or failure caused by events beyond its reasonable control, including supplier or logistics disruption, provided payment obligations remain unaffected. You may not assign these Terms without our consent; we may assign to an affiliate or in connection with a reorganisation or sale. We may use subcontractors, remaining responsible for them. Notices may be given by email — to you at your account address, to us at hello@packpeer.com. These Terms, together with the Privacy Policy and any order confirmations, are the entire agreement; if any provision is found unenforceable, the remainder stays in effect.
